Licensing Agreement

1. Use of this software and statistics is only for the league whose name(s) are on your registration form.
2. You may make unlimited backup copies of the software and data files for ARCHIVAL PURPOSES ONLY.
3. Only the person whose name appears on the registration form is deemed the representative for this league(s). Only he/she has the right to run the software package and receive technical support from CFS. This person has the official access to our Internet Web site for the weekly statistical update files. This person also accepts all responsibility for obtaining the stat files once CFS has made them available each week. CFS is not liable for any damages should the user not be able to access the files.
4. In the case any diskette that we supply is defective, CFS will replace that diskette free of charge within the first 90 days after the date of shipment. In the case any diskette that we supply is damaged in shipment, CFS will replace that diskette, ONLY AFTER you have made a claim against the shipper (either UPS, Federal Express, or the US Postal Service). However, in either case a new diskette will only be sent after the damaged diskette is returned to Center Field Software. For an Internet ship, CFS will keep the downloadable file online for a minimum of two (2) weeks. If there arises a situation where CFS must reload your downloadable file, there will be a $5 charge.
5. Except in the case of #4, this Center Field Software product is provided "as is" without warranty of any kind. The entire risk as to the results and performance of the program is assumed by you. Further, Center Field Software does not warranty, guarantee, or make any representations regarding the use of, or the results of the use of the program in terms of correctness, accuracy, reliability, currentness, or otherwise; and you rely on the program and results solely at your own risk. Center Field Software will not be liable for any damages, including but not limited to system damage, service, repair, correction, loss of profit, lost savings, or any other incidental, consequential, or special damages of any nature whatsoever resulting from the use or inability to use this product.
6. The CFS user accepts all responsibility in operation of his/her modem, communications software,and/or internet access software for downloading weekly stats for use with any Center Field Software product. Center Field Software is not responsible for technical support in the use of customer's modem, communications software, and/or Internet access software; but will be able to answer any question about using CFS's Internet site.
7. The league contact who files the licensing agreement form is the person responsible for the league's stats. The account to the Internet site will be in his/her name. Should the league change statisticians and another person does the league's stats, it is his/her responsibility to call Center Field Software and arrange for the account to be transferred over to the new person by filing a Change of Contact Form. Should any customer information (ie, address or email address) change, the league contact will inform Center Field Software of such changes. If a league contact is caught giving out his/her account and password to anyone else, his/her account will immediately be closed by CFS and an investigation will be made to determine if any further legal action will be taken.
8. This agreement may only be altered by a separate agreement made with Center Field Software.
9. All terms of this agreement will be honored by Center Field Software, including technical support, etc. Use of any of Center Field Software's software implies that the user has read, understands, and is in agreement with this document. Usage of any of Center Field Software's products imply that the user will abide by and is legally bound to this licensing agreement.
10. Center Field Software reserves the right to change, revise, or update any and all parts of this document. Upon a change, revision, or update to this document, continued usage of any of Center Field Software's products implies that the user has read, understands, and is in agreement with the revised licensing agreement. Continued usage of any of Center Field Software's products after a change, revision, or update to this licensing agreement imply that the user will abide by and is legally bound to the revised licensing agreement.
